Zapraszamy na kurs pt. „Drafting Legal Agreements”, który odbędzie się za pośrednictwem narzędzi do pracy zdalnej. O czym będzie mowa podczas kursu?
Spotkanie 1: Drafting legal agreements: an introduction
Tematyka: What is legal drafting? What are the main objectives? Accuracy and acquisition of drafting skills, client instructions, refinements and rearrangements, presentation and divisions, knowledge of the facts and the law.
Spotkanie 2: Definitions
Tematyka: Rules for the use of definitions, methods of defining words and terms, common problems in drafting definitions
Spotkanie 3: Language, part 1: Drafting as communication
Tematyka: Vagueness & ambiguity, use of short and simple words, consistency, archaic language, antiquated introductions, synonyms, negatives, active and passive voice, gender, date & time, stating expressly who has a right, power of duty
Spotkanie 4: Language, part 2: The composition of clauses
Tematyka: Objectives in composing clauses, components of clauses, tense punctuation words and spelling, provisos, the ejusdem generis rule, enumerations two provisions in one sentence
Spotkanie 5: Language, part 3: The use of particular words
Tematyka: The use of ‘shall’, use of ‘may’, use of ‘and’, and ‘or,’ avoiding ‘and/or’, use of ‘such’, use of ‘same’, use of ‘said’, use of ‘between’ and ‘among’, use of ‘where’, ‘when’ and ‘among’, use of ‘if’, use of ‘any’, ‘each’ and ‘every’, use of ‘whereas’
Spotkanie 6: Drafting pleadings
Tematyka: Statements of case, the claim form, particulars of claim, particulars of claim: examples, the defence reply and defence to counterclaim
